TripNest (“TripNest”, “we”, “us”, or “our”) operates as a hybrid travel platform, which may include a marketplace, partner-referred experiences, and TripNest-operated tours (where explicitly stated).
This Liability Disclaimer explains the limits of TripNest’s responsibility in relation to services displayed on the Platform.
1. Role of TripNestUnless explicitly stated otherwise for a specific experience:
- TripNest does not own, operate, manage, or control tours, tickets, transportation, accommodations, or experiences provided by third parties
- TripNest acts as a discovery, referral, and/or marketplace platform
- Third-party organizers and partners act as independent service providers
TripNest is not a travel agency or tour operator for partner-referred services.
2. Responsibility of Organizers and PartnersOrganizers and official partners are solely responsible for:
- Accuracy and completeness of listings
- Safety, quality, and execution of services
- Compliance with applicable laws and regulations
- Insurance, permits, and operational requirements
TripNest does not verify, endorse, or guarantee the services, claims, or conduct of organizers or partners unless explicitly stated.
3. No Liability for Partner ServicesTripNest shall not be held liable for any loss, damage, injury, delay, inconvenience, or expense arising from or related to:
- Partner-referred tours, tickets, or experiences
- Actions or omissions of organizers or partners
- Cancellations, schedule changes, or service disruptions
- Accidents, injuries, or safety incidents during travel
- Missed flights, connections, accommodations, or documentation issues
- Force majeure events, including but not limited to natural disasters, strikes, weather conditions, political events, or public health emergencies
All claims related to partner services must be addressed directly with the responsible organizer or partner.
4. Marketplace Bookings via TripNestFor bookings completed directly on TripNest:
- TripNest facilitates the transaction but does not control the delivery of the service
- Organizers remain responsible for service execution, safety, and compliance
- TripNest is not liable for the quality or outcome of organizer-provided services
5. TripNest-Operated Tours (If Applicable)Where TripNest is explicitly identified as the service provider:
- TripNest’s responsibility is limited to the terms stated on the specific experience page
- Liability, refunds, and cancellations are governed by the applicable terms for that experience
6. Traveler ResponsibilityTravelers are responsible for:
- Reviewing all booking details before confirming a reservation
- Verifying health, visa, insurance, and entry requirements
- Communicating directly with the organizer or partner regarding service-related issues
- Acting prudently and responsibly during travel
TripNest does not assess individual traveler suitability for experiences.
7. Dispute ResolutionAny disputes, claims, or complaints arising from a travel service must be resolved directly between the traveler and the organizer or partner.
TripNest may, at its discretion, assist with communication but is not obligated to mediate or provide compensation.
8. Limitation of LiabilityTo the maximum extent permitted by law:
- TripNest disclaims all warranties, express or implied
- TripNest shall not be liable for indirect, incidental, special, or consequential damages
- TripNest’s total liability, if any, shall not exceed the fees paid directly to TripNest (if applicable)
9. Changes to This DisclaimerTripNest may update this Liability Disclaimer from time to time.
The latest version will be published on the Platform with an updated revision date.
